The Grand Failure: How the VA and Government Are Failing to Protect Veterans from Foreclosure

Updated: Dec 22, 2024

In a devastating betrayal of the very families they claim to serve, the U.S. Department of Veterans Affairs (VA) and the federal government have left countless veteran households vulnerable to financial ruin. Instead of providing meaningful solutions to stave off foreclosure, bureaucratic red tape and punitive policies have subjected veterans to unnecessary financial violence, pushing them further into hardship.

The Growing Crisis

Veterans who have bravely served their country now find themselves facing an unthinkable enemy: the looming loss of their homes. For many, VA-backed mortgages were marketed as a lifeline—a way for service members to secure affordable housing after years of sacrifice. However, for families already struggling under economic pressures, these mortgages have become a double-edged sword.

A particularly egregious example of this systemic failure is the exclusion of veterans who have filed for Chapter 13 bankruptcy protection from the VA’s newly introduced Veteran Assistance Servicing Purchase (VASP) program. Designed to provide relief to struggling veteran homeowners by allowing the VA to purchase defaulted loans and refinance them, the program sounds promising on paper. Yet, veterans who proactively filed for Chapter 13 bankruptcy—a legal process that helps individuals repay debts and save their homes—are rendered ineligible.

This policy not only punishes veterans for seeking help but also fails to recognize the very nature of Chapter 13 bankruptcy: a structured effort to honor financial commitments while protecting assets. By disqualifying these families, the VA and government are turning their backs on veterans during their time of greatest need.

Financial Violence Against Veterans

The exclusion from VASP is just one example of how the government’s policies inflict unnecessary financial violence on those who served. Veterans facing foreclosure are often trapped in a cruel cycle of stress, shame, and economic instability. Instead of offering holistic support or pathways to recovery, the system penalizes families for trying to do the right thing.

Moreover, the VA’s outdated processes fail to account for modern economic realities. With rising housing costs, stagnant wages, and unforeseen financial setbacks, many veteran households find themselves on the brink of foreclosure through no fault of their own. The VA’s refusal to adapt its policies only exacerbates the crisis.

A System Designed to Fail

For veteran families, the promise of VA-backed homeownership has turned into a nightmare. While programs like VASP should represent a beacon of hope, exclusionary rules and bureaucratic hurdles have made meaningful relief unattainable for those who need it most. These policies ignore the complexity of veterans' financial struggles and instead prioritize rigid compliance over compassion.

The hypocrisy is glaring. Veterans who sought Chapter 13 protection did so to save their homes and honor their debts. Instead of being rewarded for their determination, they are punished, excluded, and left with no viable path forward.

The Call for Change

It is time for the VA and the federal government to take responsibility for this catastrophic failure. Veteran families deserve policies that support them, not ones that drive them further into despair. Immediate reforms must include:

  1. Removing Chapter 13 exclusion: Veterans who filed for bankruptcy to save their homes must be eligible for programs like VASP.

  2. Streamlining foreclosure assistance: Bureaucratic hurdles that delay or deny relief must be eliminated.

  3. Providing holistic financial support: Veterans need counseling, education, and pathways to long-term financial stability.

  4. Accountability and oversight: The VA must ensure its programs align with the real-world needs of veterans and their families.

A Broken Promise

When veterans signed up to serve their country, they were promised support and respect in return for their sacrifice. The current system—one that punishes and excludes families who are fighting to save their homes—is a betrayal of that promise.

The financial violence inflicted by the VA and government policies must end. Until meaningful reforms are implemented, veterans and their families will continue to suffer needlessly. Their sacrifice deserves more than lip service; it demands action. The time for change is now.
